Real Estate Contracts
We will sign a listing agreement known as an Exclusive Agency Contract with you the seller. This contract states that the seller agrees to pay the buyers broker a fee or commission. The commission is paid when the property is sold . The commission may be reduced or eliminated if, for example, you find the buyer, rather than the listing broker. This kind of listing can be used to provide a limited range of real estate services. Knoxville Discount Realty elects to charge a one time fee for listing your property to put into the MLS for six months. You would be responsible for every other aspect of the transaction, like advertising, running open houses, negotiating with buyers, and coordinating the closing, in the event you decide you need some help with these or other items, we will be happy to negotiate a modest fee for helping with one or all. There will be no commission paid KDR. This practice sets us aside from full service brokers. We are Fee-For-Service Brokers.
The other type of listing is an Exclusive Right-To Sell Contract, where you agree to pay the broker a commission no matter who finds the buyer – even you. This is the kind of agreement usually used for a seller to obtain the full range of traditional brokerage services.
Selling real estate involves a lot of paperwork. To be legally enforceable, documents like listing contracts, sales agreements, offers, and counteroffers must be in writing. We at KDR want you to know what the writing means. We will explain any forms or documents that you do not understand as best we can. By law, real estate agents are only allowed to fill-in the blanks of pre-printed forms that have been prepared by an attorney.
