In April of 2007, the Federal Trade Commission and the Department of Justice released a lengthy report called Competition in the Real Estate Brokerage Industry. It examines so-called “minimum” service laws, which lobbyists have sought in order to mandate that sellers receive certain services from real estate brokerages, whether they want them or not.

The Antitrust Division of the Department of Justice maintains a public website called Competition in Real Estate. It is a good resource for consumers wanting to save money and not be taken advantage of.

The Federal Trade Commission also maintains a Competition in the Real Estate Industry website, which includes a Consumer Education section. These pages explain some of your selling options, including the Exclusive Agency listing agreement we use.

The FTC and DOJ have also pursued enforcement actions to protect consumer choice.
